Now that we are witnessing the merging of two extremely viable and highly profitable business industries, the cap has been lifted on the possibility of success. In fact, the total annual growth projections in recreational marijuana sales in California are skyrocketing every single day, which means that there could be no limit to your start-up potential.

Opening a recreational marijuana dispensary in California can be tricky. New and always evolving state laws and regulations can be overwhelming and confusing.

In 2016, Proposition 64, also known as the AUMA, or the Adult Use of Marijuana Act, was approved. Then, in June of 2017 Governor Brown drafted a legislature known as SB 94, otherwise known as the Medicinal and Adult Use Cannabis Regulation and Safety Act (MAUCRSA). This effectively repeals the Medical Cannabis Regulation and Safety Act (MCRSA), incorporates certain aspects of it with the AUMA, and creates an entirely new set up laws which will now govern a combined medicinal and recreational bill, slated to take effect fully by January of 2018.

There are a number of changes slated to go into effect with the passage of SB 94. There are environmental policies that will be newly introduced which will, hopefully, create a safer and more regulated cultivation and retail industry. Public safety is being looked at under a microscope now, with more focus on marketing safety and product sales, being that both medicinal and recreational sales will be legal.

In addition to all of this, and possibly the most important part of this entire puzzle, are the changes in licensing. In effect, many licensing limitations have been removed, as have the number of licenses a person or business can hold simultaneously. Another incredible piece to this is that residency requirements have been taken out of the equation, which means that you do not need to be a resident of California to open up shop here. This effectively creates an entirely new definition of what it means to be a business owner in the state of California, allowing many people and businesses to now obtain licenses and open up shop in our fair state.

Competition is going to be fierce. Are you ready for what’s to come?

There are a number of changes happening right now in California. The most important of all of these could be the ability to obtain a recreational cannabis license. Just a few months ago, things were much different. The laws set in place at the time limited a startup’s ability to own and operate a recreational marijuana startup—as in, you couldn’t. Prior to the MAUCRSA, the only way to open a startup was to operate a medical marijuana dispensary or delivery service. A brick and mortar storefront was necessary and, with that, came many restrictions.

Now, it is more than possible to fill out a recreational cannabis application, apply for a recreational cannabis license, and open a recreational marijuana dispensary or startup without having to adhere to all of the strict medicinal policies that were in place.

With just the scratch of a pen, Governor Brown and the California state legislature opened up a new world for recreational marijuana. And it’s going to be glorious.

Recreational sales in the state of California are scheduled to begin on January 2, 2018. Because of this limited timeline, it is imperative that you get your paperwork together and all applications submitted to the state well before that deadline to be considered for any potential licenses.

Why struggle with figuring out how much it will cost to open a dispensary, or how to legitimately get a recreational marijuana license? There are still many steps to take in order to make the process run smoothly and without any interference from the newly created “Bureau of Cannabis Control”; application fees, zoning fees, regulatory fees, and licensing fees. Although the game is changing, there are many parts of the process that remain the same. Let Start Your Collective help you envision and create the formula for your success.

With the passage of SB 94, California is getting ready to change the traditional model of brick and mortar business radically.
